Will Generator — Write a Simple Will for India in Minutes

No will yet? Draft a simple one in 10 minutes — executor, gifts, the rest of your estate and two witnesses.

Which law applies
Muslims in India may leave only one-third of their estate by will; the rest goes to the heirs under personal law.
About you (the testator)
Executor
The person who carries out your will. A beneficiary can be the executor.
Who gets what
Write “[what] to [whom]”, e.g. “my flat No. 12, Shanti Apartments, Pune to my son, Arjun Example”. Describe property clearly enough to identify it. Each line becomes “I give and bequeath …”.
The residue clause catches anything not listed above, including property you acquire later.
Witnesses, place and date

Two adults who see you sign. Do not use anyone who receives a gift under the will, or their husband or wife.

Leave empty to write the date by hand on the day you sign.
Paper

A template, not legal advice. A will decides who gets everything you own — have a lawyer check it, especially for joint family property, property abroad or a business. Rules checked on 30 October 2026.

A simple will, written properly

Without a will, your property passes under the succession law that applies to you — which may not be what you want, and often leads to delays and disputes. This free will generator writes a simple, clear will for India: your declaration, an executor, specific gifts, a clause for everything else, a guardian for young children, and an attestation by two witnesses in the form section 63 of the Indian Succession Act, 1925 requires.

You fill in the details; the will is written in plain English, ready to download as a PDF or Word file and print. Nothing you type leaves your browser. It suits straightforward estates. It is a template, not legal advice: if you own joint family (HUF) property, property abroad or a business, or expect a dispute, have a lawyer draft or check it.

How to use the Will Generator

  1. Choose which law applies — the Indian Succession Act for most people, Muslim personal law, or a general format outside India.
  2. Enter your name, your father’s or spouse’s name, age and address, and name an executor (and a substitute if you like).
  3. List your gifts one per line — “what” to “whom” — and say who gets everything else.
  4. Add a guardian for minor children or funeral wishes if you want, then fill in the two witnesses.
  5. Download and print, then sign every page in front of both witnesses, who sign the attestation in your presence.

What makes a will valid in India (as of 30 October 2026)

Sources: the Indian Succession Act, 1925 (the Tripura High Court’s copy) and the Registration Act, 1908 (the Uttarakhand registration department’s copy), read 30 October 2026. Part VI of the Act does not apply to Muslims (s.58), whose wills follow Muslim personal law: no more than one-third of the estate after funeral expenses and debts may be left by will, and in Hanafi law a bequest to an heir needs the other heirs’ consent. That rule is from personal law and court decisions, not a statute, and a challenge to it is pending in the Supreme Court. Probate is compulsory only in some cases — mainly wills of Hindus, Buddhists, Sikhs, Jains and Parsis concerning Mumbai, Kolkata and Chennai (s.213, s.57).

Signing your will — practical tips

  • Sign in front of both witnesses together. The law allows separate attestation, but doing it together avoids doubt later.
  • Choose independent witnesses — adults who get nothing under the will. A doctor’s note on your fitness helps if your health may be questioned.
  • Describe property precisely — flat number, survey number, bank and branch — so there is no confusion.
  • Keep it safe and tell someone. Registering it with the Sub-Registrar, or depositing it in a sealed cover, protects the original.
  • Update it after marriage, divorce, a birth or a big purchase. Under s.69, marriage revokes an earlier will for those it applies to.

Will Generator FAQ

How do I write a will in India?

Write down your details, name an executor, list who gets which property, say who gets the rest, then sign it in front of two witnesses who also sign. This will generator writes those clauses for you.

Is a handwritten or typed will valid without registration?

Yes. Registration is optional (Registration Act, s.18(e)). What matters is that you sign it and two witnesses attest it.

Does a will need stamp paper or a notary?

No. A will needs no stamp duty and does not have to be notarised; plain paper is fine.

Can a beneficiary be a witness to the will?

They can sign, but the gift to them (or to their spouse) becomes void. Use independent witnesses.

How much property can a Muslim leave by will?

Under Muslim personal law, up to one-third of the estate after funeral expenses and debts, unless the heirs consent to more. Choose the Muslim mode here to add that clause.

Can I change my will later?

Yes, at any time — make a new will that revokes the old one, or a codicil signed and attested the same way.
